“Frivolous” David Protein Lawsuit Dropped

The class-action lawsuit that rocked David Protein has been quietly dropped, with no further action to be taken. 

Filed in January by lead plaintiff Daniella Lopez, the case alleged that David Protein’s bars contained 83% more calories and 400% more fat than advertised.

This claim spread like wildfire across social media and drew inevitable comparisons to Mean Girls’ Regina George.

The David Protein Lawsuit Explained

At the heart of the controversy was a single ingredient: esterified propoxylated glycerol, or EPG, a modified plant-based fat substitute that passes through the body largely undigested.

The plaintiffs argued that independent lab testing – using what’s known as a ‘bomb calorimeter’ – revealed the bars to be far more calorie-dense than their labels suggested. 

However, David fired back, insisting the testing method was fundamentally flawed, and that FDA regulations require a different calculation for non-digestible ingredients like EPG.

David Founder Peter Rahal was unequivocal from the start, calling the David Protein Lawsuit “frivolous” and insisting the bars were only 150 calories.

And now the plaintiffs have walked away from the case without further explanation. 

In response, David issued a measured statement confirming it was “pleased the matter has been resolved” and standing firmly behind the accuracy of its nutrition labelling.

David’s ever-growing following will also no doubt be relieved to hear that they aren’t consuming more calories than they’d thought.

The bars launched in September 2024 and quickly became one of the most talked-about snacks in the wellness space, thanks to delivering 28g of protein for just 150 calories – one of the strongest protein-to-calorie ratios on the market.

They come in a range of indulgent flavours, including Chocolate Chip Cookie Dough, Fudge Brownie, and Cake Batter.
